End User License Agreement

1. License Grant

Breakinsoft grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use Be Focus strictly in accordance with the terms of this Agreement.

• The Application is licensed, not sold, to you.
• You may use the Application on devices that you own or control.
• You may not distribute or make the Application available over a network where it could be used by multiple devices at the same time.

2. License Restrictions

You agree NOT to:

• Copy, modify, or create derivative works of the Application.
• Reverse engineer, decompile, or disassemble the Application.
• Remove, alter, or obscure any proprietary notices on the Application.
• Use the Application for any illegal or unauthorized purpose.
• Rent, lease, lend, sell, redistribute, or sublicense the Application.
• Use the Application to transmit viruses, malware, or other harmful code.
• Attempt to gain unauthorized access to any portion of the Application or its related systems.

3. Intellectual Property

The Application, including all content, features, and functionality, is owned by Breakinsoft and protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

All trademarks, service marks, and logos used in connection with the Application are the property of Breakinsoft or their respective owners.

4. User Content

You retain ownership of any content you create, upload, or store using Be Focus. By using the Application, you grant Breakinsoft a limited license to use, store, and process your content solely for the purpose of providing the Application's services to you.

You are solely responsible for your content and must ensure you have all necessary rights to use and share it through the Application.

5. Purchases and Subscriptions

Be Focus may offer in-app purchases and subscriptions. All purchases are processed through your device's app store (Apple App Store or Google Play Store) and are subject to their terms and conditions.

• Payments are charged to your app store account at confirmation of purchase.
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
• You can manage or cancel subscriptions through your app store account settings.
• Refunds are handled according to the app store's refund policy.

6. Free Trial

Be Focus may offer a free trial period for certain features or subscriptions. At the end of the trial period, you will be automatically charged unless you cancel before the trial ends.

We reserve the right to determine your eligibility for a free trial and may limit one free trial per user.

7. Privacy and Data Collection

Your use of Be Focus is also governed by our Privacy Policy. By using the Application, you consent to the collection and use of your information as described in our Privacy Policy.

8. Third-Party Services

Be Focus may integrate with third-party services or contain links to third-party websites. Breakinsoft is not responsible for the content, privacy policies, or practices of any third-party services.

Your use of third-party services is at your own risk and subject to their respective terms and conditions.

9. Updates and Modifications

Breakinsoft may provide updates, upgrades, or modifications to Be Focus at any time. These updates may modify or remove features and functionality.

We reserve the right to modify or discontinue the Application, temporarily or permanently, with or without notice.

10. Disclaimer of Warranties

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Breakinsoft does not warrant that the Application will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BREAKINSOFT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

In no event shall Breakinsoft's total liability exceed the amount you paid for the Application in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Breakinsoft and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Application or violation of this Agreement.

13. Termination

This Agreement is effective until terminated by you or Breakinsoft. Your rights under this Agreement will terminate automatically without notice if you fail to comply with any term.

Upon termination, you must cease all use of the Application and delete all copies from your devices.

Sections that by their nature should survive termination shall survive, including but not limited to intellectual property rights, disclaimers, and limitations of liability.

14. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which Breakinsoft operates, without regard to its conflict of law provisions.

Any disputes arising from this Agreement shall be resolved through binding arbitration or in the courts of the applicable jurisdiction.

15. Changes to This Agreement

We reserve the right to modify this Agreement at any time. We will notify you of any material changes by updating the "Last updated" date and, when appropriate, through the Application.

Your continued use of Be Focus after changes become effective constitutes your acceptance of the revised Agreement.

16. Severability

If any provision of this Agreement is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect.

17. Entire Agreement

This Agreement, together with our Privacy Policy, constitutes the entire agreement between you and Breakinsoft regarding the use of Be Focus and supersedes all prior agreements and understandings.
